Summer is here, and as you’re gearing up for the next big adventure, you might wonder whether your CBD is clear for takeoff. For the time being, CBD is still in a weird legal gray-area in many parts of the country, so it’s important to know a few facts and tips before traveling with CBD to make sure your vacay doesn’t go up in smoke.

 


Are You Traveling High or Low?

How you plan to get to your destination is a factor in how to travel with your CBD vape pen. If you’re taking to the skies, you’re going to have to deal with the TSA. If your CBD is hemp-derived, you could be okay—but keep in mind that every state will have different laws you must follow.

There isn’t clear-cut guidance, but for what it’s worth, the TSA did post on their official Instagram account that they don’t actively search for marijuana or other drugs and their screening practices are based on security and detecting potential threats. Since CBD isn’t a drug, it’s likely to be not a big deal. On the other hand, there’s no guarantee that you won’t get delayed if they’re unfamiliar with the difference between hemp-derived CBD and cannabis (in which case law enforcement could be notified). So, if you plan on flying with CBD, make sure that it is appropriately packaged and stowed away and isn’t above their liquid/gel/aerosol limits.

If you’re going on a road trip, you need to consider the laws of not only your destination but also of any places you’ll be passing through. As soon as you cross an interstate line, the local laws apply, so even if you bought the CBD legally in Oregon, in Idaho, it would be a different story. Plan your trip accordingly and decide for yourself.

No Cannabis = Usually Okay

At the federal level in the U.S., thanks to the Farm Bill, hemp-derived CBD is legal as long as it falls below the federal mandate of 0.3% THC or less. But you should take this with a grain of salt as some states view CBD differently—as you might have heard from the Disney World incident where a great-grand mother was arrested for bringing her CBD oil into the park.

If you’re going to travel with CBD, if someone with a badge in a state where weed isn’t legal decides to take issue, you need to have the right paper to certify that your CBD is, in fact, non-psychoactive with 0% THC. This paperwork is called a Certificate of Analysis (COA for short), and it’s what the third-party testing agency provides brands to certify that it passed their tests. With that information in hand, although not always a guarantee if you’re traveling in a super-strict anti-hemp state, it’s better than nothing to establish that you’re legally entitled to be carrying the product.

While there isn’t a clear-cut rule about how to travel with CBD, if you don’t want to take any risks, your best bet is to leave it at home and purchase a disposable vape pen once you arrive at your CBD-friendly destination, or have it shipped to your host’s address.
